Terms of Sale

Version française · Versión en español
Where Athina AD is offered. Athina AD accounts and plans are offered only to individuals resident in, and organisations established in, the United States, Canada or Mexico. The service is not offered to customers elsewhere. OMAC (FZE), based in the UAE, makes and operates Athina AD. Paid plans are sold by OMAC's authorised reseller, AI For The Blind Corporation. These documents are provided in English, French and Spanish. This market restriction does not waive any rights or obligations that applicable law requires.
These Terms of Sale cover buying an Athina AD plan: price, payment, tax, renewal, cancellation and refunds. Using Athina AD is covered by the Terms of Use, which OMAC (FZE), the company that makes and runs Athina AD, gives you whoever sold you the plan.
Paid-plan availability. Paid plans are not currently available. The purchase and billing provisions below apply when paid plans are offered for purchase.
The short version
- Athina AD is bought only on athinaad.com. Links from other websites, such as aiftb.com, bring you to our pricing page. Plans are not sold inside the apps or through app stores.
- Your Seller is AI For The Blind Corporation, OMAC's authorised reseller in the United States, Canada and Mexico. You pay through AI For The Blind's own Stripe account, and its name appears at checkout, on your receipt and on your card statement.
- OMAC makes and runs Athina AD and handles all customer help, including cancellations and refund requests, for the Seller.
- Subscriptions renew every month and you are charged each month until you cancel. You can cancel online at any time; you keep access until the end of the month you paid for.
- Subscription minutes are for the current billing month only. Top-up minutes can be bought while you have a paid subscription and do not expire. We use your subscription minutes first, because they expire, and then your top-up minutes.
- Prices are in US dollars, plus any tax that applies where you live. If your billing address is in Mexico, prices are shown and charged in Mexican pesos, with IVA included.
- Refunds follow our Refund and Cancellation Policy. You always keep the rights the law gives you.
1. Who sells to you
1.1 Where you buy. Athina AD plans are sold only on the Athina AD website, athinaad.com. Other websites, including AI For The Blind Corporation's website aiftb.com, may link to our pricing page, but they do not sell Athina AD. Plans cannot be bought inside the Athina AD apps or through Apple's App Store or Google Play.
1.2 Your Seller is AI For The Blind Corporation, a Texas nonprofit corporation, 2809 NW Loraine St, Fort Worth, TX 76106-3843, USA ("AI For The Blind"). AI For The Blind is OMAC's authorised reseller of Athina AD in the United States, Canada and Mexico, and sells plans in its own name. You pay through Stripe, on AI For The Blind's own account. AI For The Blind's name appears at checkout, on your receipt and on your card statement.
1.3 Eligibility and billing address. Plans are offered only to individuals resident in, and organisations established in, the United States, Canada or Mexico, and your billing address must be in one of those countries. Do not purchase if you are outside that customer group. The checkout asks for your billing address, which is used for tax, payment eligibility and legal requirements. If the country of your billing address is not one of those three countries, we may cancel the purchase and refund you in full. Plans are not currently offered elsewhere. Availability is also subject to applicable law and payment restrictions.
1.4 Your Seller stays the same for as long as your subscription continues, even if you travel or move. Section 10.4 explains what happens if your Seller ever changes.
1.5 In these Terms, "Seller", "we" and "us" mean AI For The Blind. Where these Terms describe something done through the Athina AD website or your account, such as applying a cancellation, returning minutes or sending an email, OMAC does it for the Seller, as Section 1.6 explains. "OMAC" means OMAC (FZE), Trade Licence No. 11651, issued by the SRTI Free Zone Authority, Block B, Office B58-111, Sharjah Research Technology and Innovation Park, University City, Sharjah, United Arab Emirates, P.O. Box 66636, the company that makes and runs Athina AD; its company website is onemoreaicompany.com. "You" means the person or organisation buying the plan.
1.6 Who does what.
- The Seller sells you the plan: it takes your payment, charges the right tax, sends your receipts, pays any refund owed to you, and is responsible for the sale.
- OMAC makes and runs Athina AD under the Terms of Use and provides customer help for every purchase. AI For The Blind has asked OMAC to handle its customers' questions, cancellations and refund requests. OMAC applies them in the Seller's payment account on the Seller's behalf, so a refund comes from your Seller.
- AI For The Blind does not make or run Athina AD. It cannot change the Terms of Use or make promises about the service on OMAC's behalf.
1.7 Only Athina AD. These Terms cover Athina AD only. AI For The Blind's other products, programmes, memberships and donations are covered by its own terms, not these.
2. What you can buy
2.1 The plans, what each includes, and their prices are shown on our pricing page and in your account before you pay. The offers covered by these Terms are:
- Free plan: no payment. A monthly allowance of video minutes.
- Monthly subscriptions (Basic and Creator): a monthly allowance of video minutes and the features of that plan.
- Top-up minutes: extra video minutes, paid once. You can buy top-up minutes only while you have an active paid subscription, from the Billing page of your account.
- Enterprise: by separate written agreement. Contact support@athinaad.com.
2.2 Subscription minutes are for one billing month. Any minutes you do not use expire at the end of that billing month and do not carry over.
2.3 Billing months. A billing month starts on the day and time your subscription started (or last renewed) and ends at the same time on the same day of the next month. If that day does not exist in the next month, it ends on the last day of that month. For example, a subscription started on 31 January renews on 28 February (29 in a leap year), then on 31 March.
2.4 Top-up minutes do not expire. They stay in your account until you use them. They end only if your account is permanently deleted at your request (Section 5.4); we do not close an account for inactivity while it holds top-up minutes.
2.5 Dates and times. We record every billing time in Coordinated Universal Time (UTC). Your account shows the exact date and time your current billing month ends and your subscription minutes expire, in your local time, and how many top-up minutes you have.
2.6 Which minutes we use first. When you run a job, we use your subscription minutes first, because they expire at the end of the billing month, and then your top-up minutes.
2.7 Top-up minutes after you cancel or change plan. Top-up minutes you have bought stay in your account, even if you cancel your subscription or move to a lower plan. You can use them on whatever plan you are on when you run a job, including the free plan. Each job gets the features of your current plan, such as output types, storage, marks and advertisements; top-up minutes add minutes, not features.
2.8 How minutes are counted.
- A job uses minutes based on the length of the video you submit, not on what we produce.
- We count whole minutes. If the part left over after the last whole minute is more than 55 seconds, it counts as one more minute; otherwise it is not counted. Every job counts as at least 1 minute. For example, a 2 minute 30 second video uses 2 minutes, a 2 minute 56 second video uses 3 minutes, and a 20 second video uses 1 minute.
- A job is counted once, however many outputs you choose (for example script, audio and video, or two versions).
- If we retry part of your job ourselves, you are not charged again. Submitting a video again starts a new job, which is counted again.
2.9 Minutes returned for failed jobs. If a job fails because of a problem on our side, the minutes it used are returned automatically to where they came from. Returned top-up minutes do not expire. Returned subscription minutes keep the end of their billing month; if fewer than 7 days of it remain, or it has already ended, they can be used for 7 days from when they are returned. If a job finishes but an output you chose is missing because of a problem on our side, write to support@athinaad.com and we will return the minutes.
2.10 Digital delivery and access. Athina AD is an online software service; no physical goods are shipped and there are no shipping or physical-return charges. When paid plans become available, subscription access and purchased extra minutes will be added to your account after payment is confirmed. Any cancellation or refund rights required by applicable law remain protected under Section 5 of the Refund and Cancellation Policy. Processing begins when you submit a job; completion time varies with the video and demand. Completed outputs are delivered through the results page, with storage and download availability explained in the Privacy Policy. We do not guarantee completion by a particular time unless agreed in writing. If paid access or minutes are not delivered, contact support@athinaad.com; our Refund and Cancellation Policy and your legal rights apply.
2.11 Technical requirements. You need an internet connection, a compatible supported browser or Athina AD app, and an account. Any plan-specific limits, supported input/output formats and material compatibility restrictions are shown before purchase. Your internet or mobile provider may charge its normal fees. Do not buy a plan if its stated requirements do not meet your needs.
3. Prices and tax
3.1 Prices and charges are in US dollars (USD). Your payment provider may apply its own currency-conversion charges if your payment account uses another currency. If your billing address is in Mexico, prices are shown and charged in Mexican pesos (MXN), and the price shown already includes IVA and every other charge, so the amount shown is the total you pay.
3.2 Applicable tax is added on top of the price where the law requires it, for example US sales tax, Canadian GST/HST and QST, or Mexican IVA, based on the information relevant to your purchase, including your billing address. Your Seller is responsible for charging and paying the taxes it is required to collect. The full total, including applicable tax, is shown before you pay. In Mexico, IVA is already included in the peso price (Section 3.1).
3.3 Payments for Athina AD are purchases, not charitable donations, and are not tax-deductible, even though the Seller is a nonprofit. No charitable tax deduction is offered.
3.4 If you buy for an organisation and claim a tax exemption, provide valid evidence before purchase. We apply an exemption only where the applicable law permits; a business name or tax number alone does not establish an exemption.
4. Payment and automatic renewal
4.1 You pay when you buy. Accepted payment methods are shown at checkout.
4.2 Subscriptions renew automatically. By subscribing, you agree that your subscription renews every month and that the price of your plan, plus tax, is charged to your payment method at the start of each billing month until you cancel. The price, the billing date and how to cancel are shown before you confirm, and in the confirmation email.
4.3 If a renewal payment fails, we email you and try the payment again several times over up to 7 days. While we try, the subscription minutes for your new billing month are not added. You can still use your top-up minutes with your plan's features, and results already saved in My Described Videos stay available. If a later attempt succeeds, that billing month's subscription minutes are added at once, and your billing date does not change. If no attempt succeeds within those 7 days, the subscription ends and your account moves to the free plan; your top-up minutes are kept.
4.4 Changing plan.
- Moving to a higher plan takes effect at once. You pay now only the difference for the rest of your current billing month, worked out by the number of days left, and your billing date stays the same. For the rest of that month, your minutes become the new plan's monthly allowance minus the minutes you have already used this month.
- Moving to a lower plan takes effect at the start of your next billing month. You keep your current plan and its minutes until then, and are not charged for the change.
4.5 Your Seller sends a receipt for every payment, in its own name.
4.6 Consent and reminders. We obtain the consent to recurring charges required by applicable law and provide an acknowledgement of the subscription terms, cancellation method, renewal reminders and any additional price-change notices required by that law. You may cancel without being required to accept another offer or contact a salesperson. A statutory cancellation or notice right takes priority over a less protective term here.
5. Cancelling
5.1 You can cancel a subscription at any time, online, on the Billing page of your Athina AD account. You can also email support@athinaad.com.
5.2 When you cancel, your subscription stops renewing. You keep your plan's features until the end of the billing month you have paid for. After that, your account moves to the free plan. Your top-up minutes stay in your account.
5.3 Cancelling does not by itself give you a refund for the current month, except as our Refund and Cancellation Policy or the law provides.
5.4 If you ask to delete your Athina AD account:
- your subscription stops renewing at once, so you are not charged again;
- your account is locked, and for 30 days you can restore it (see Section 15 of our Privacy Policy);
- restoring your account does not restart your subscription. When you restore it, we show you when your paid month ends and ask whether you want to restart monthly billing. Your subscription renews again only if you choose to restart it;
- if your paid month ends during the 30 days, your plan ends then. If you restore your account after that, it is on the free plan, and you can subscribe again;
- if you do not restore your account, it is permanently deleted after 30 days. Any paid time left in your billing month and any remaining top-up minutes end at that moment, without a refund, unless the law gives you a right to one. Before you confirm the deletion, we show you how much paid time and how many minutes you will lose.
6. Changes to prices and plans
6.1 We may change prices or plans. A price change never applies to a billing month you have already paid for.
6.2 Before a new price applies to your subscription, we will email you 30 days in advance, saying what changes, when, and how to cancel. If you do not want to pay the new price, cancel before it applies, without cost or penalty.
7. Refunds and cancellation rights
7.1 Refunds follow our Refund and Cancellation Policy, which is part of these Terms.
7.2 Mandatory rights. You keep any cancellation and refund rights required by the law of the country, state or province where you live. The Refund and Cancellation Policy explains those rights and how to contact us. These Terms do not offer plans outside the United States, Canada and Mexico, and do not remove rights arising from earlier purchases.
8. If something goes wrong with your purchase
8.1 Your Seller is responsible for the sale: taking your payment correctly, charging the right amount, applying your cancellation, and giving refunds owed to you. OMAC is responsible for the service, as the Terms of Use explain.
8.2 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot be limited or excluded by law.
8.3 Subject to Section 8.2, the Seller's total liability to you for a purchase is limited to the amount you paid for it, and the Seller is not liable for losses that were not reasonably foreseeable. For consumers, these limits apply only to the extent applicable law allows. In Québec, this section does not apply to consumers to the extent the Consumer Protection Act prohibits it. In Mexico, it does not apply to the extent the Ley Federal de Protección al Consumidor prohibits it.
9. Disputes and governing law
9.1 Please contact support@athinaad.com first. Most problems can be solved quickly.
9.2 Disputes with your Seller about a purchase. These Terms and your purchase are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules, subject to the mandatory consumer protections below.
- If you live in the United States, disputes with AI For The Blind about a purchase are resolved by binding individual arbitration, on the same terms as Section 21 of the Terms of Use, reading "AI For The Blind" in place of "OMAC", including its exceptions, its class-action waiver and the 60-day notice period. You can opt out: email support@athinaad.com with the subject "Arbitration Opt-Out" within 30 days after your first purchase, or after you first accept Section 21 of the Terms of Use, whichever is later. One email opts you out of arbitration with both OMAC and AI For The Blind; you do not need to send two.
- If you are a consumer in Canada, you keep the protections of your province's consumer protection law and may bring proceedings in its courts. Arbitration does not apply to you. In Québec, the Consumer Protection Act and the courts of Québec apply.
- If you are a consumer in Mexico, you keep the protection of the Ley Federal de Protección al Consumidor and may go to PROFECO or the competent Mexican courts. Arbitration does not apply to you, and nothing in these Terms submits you to the courts of another country.
9.3 Disputes with OMAC about the service follow Sections 20 and 21 of the Terms of Use.
9.4 Mandatory consumer rights remain. The choice of law, courts and arbitration does not remove protections or remedies that applicable law does not allow you to waive. The market restriction in these Terms does not retrospectively alter earlier purchases.
10. General
10.1 These Terms, the Refund and Cancellation Policy and the Terms of Use are the whole agreement about your purchase. For anything about buying a plan, these Terms and the Refund and Cancellation Policy take priority over the Terms of Use, as Section 22 of the Terms of Use also says.
10.2 We may update these Terms. Changes do not apply to a period you have already paid for. For important changes, we will email you at least 30 days before they apply to you, setting out the new or changed clause, how it read before, and the date it takes effect; you may then cancel without cost or penalty.
10.3 If a court finds part of these Terms invalid, the rest stays in force.
10.4 If your Seller changes. If AI For The Blind stops selling Athina AD, or OMAC appoints a different Seller for your country:
- you keep everything you have already paid for: your plan until the end of the billing month you paid for, and your remaining top-up minutes. OMAC keeps providing the service for them, whoever the new Seller is;
- before any further payment is taken, we will tell you who the new Seller is and ask you to confirm that you want your subscription to continue. If you do not confirm, your subscription ends at the end of the period you paid for, your account moves to the free plan, and your top-up minutes stay in your account;
- if, for any reason, the service you have already paid for cannot be provided, you will receive a refund of the unused part.
10.5 Language. These Terms are available in English, French and Spanish. For consumers in Québec, the French version applies unless you expressly choose another version after receiving the French one. For consumers in Mexico, the Spanish version applies. In all other cases, the English version applies if the versions differ.
