2. Filing a takedown notice

Under section 512(c) of the DMCA, a valid notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or of a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works at a single site are covered by a single notice).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate it — for ATHINA AD, that means the specific result URL, transcript identifier, or job ID, along with the source video title or link if available.
  4. Reasonably sufficient contact information for you (the complaining party): full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or authorized to act on its behalf.

Warning. Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Do not make false claims.

3. What happens after we receive a notice

  • We will acknowledge receipt of your notice within a reasonable time.
  • If the notice is valid on its face, we will expeditiously disable access to the identified material.
  • We will make a reasonable effort to notify the user who submitted the underlying content of the takedown, and to provide them a copy of the notice (with your personal contact information redacted only where allowed by law).
  • If we determine the notice does not comply with section 512(c)(3), we may contact you for clarification before acting.

4. Counter-notice procedure

If you believe content you submitted was removed in error or as a result of misidentification, you may file a counter-notice. Send it to abuse@athinaad.com with the subject "DMCA Counter-Notice" and include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location at which it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which ATHINA AD may be found), and that you will accept service of process from the person who provided the original takedown notice, or an agent of that person.

If we receive a valid counter-notice, we will forward it to the original complaining party. Unless they file a court action seeking a restraining order against you within 10 to 14 business days, we may restore the removed material.

5. Repeat-infringer policy

In appropriate circumstances, ATHINA AD will terminate the accounts of users who are determined to be repeat infringers. We may also disable an account temporarily while a notice or counter-notice is being processed. Termination decisions are at our reasonable discretion and follow internal review.

6. Notice about AI-generated descriptions

ATHINA AD produces AI-generated transcripts, written descriptions, and synthesized narration audio derived from the source video you submit. Per our Terms of Service, you represent that you own the source material or have the rights to process it. If you are the rightsholder of a source video that was submitted to ATHINA AD without your authorization, our DMCA process applies to the corresponding generated outputs and we will act on a valid notice.
